AbregoGarcia,29,wasdeportedtoanElSalvadoranmegaprisonlastmonthforbeinganallegedMS-13gangmember.U.S.DistrictJudgePaulaXinisorderedtheDepartmentofHomelandSecurityandHomelandSecuritySecretaryKristiNoemtoreturnAbregoGarciatotheU.S.,wherehewaslivinginMaryland.
“AlthoughthelegalbasisforthemassremovalofhundredsofindividualstoElSalvadorremainsdisturbinglyunclear,AbregoGarcia’scaseiscategoricallydifferent—therewerenolegalgroundswhatsoeverforhisarrest,detention,orremoval,”Xiniswrote.
“NordoesanyevidencesuggestthatAbregoGarciaisbeingheldinCECOTatthebehestofSalvadoranauthoritiestoanswerforcrimesinthatcountry.Rather,hisdetentionappearswhollylawless,”shecontinued.
